A federal judge pushed the Department of Justice throughout a hearing Thursday about whether President Donald Trump followed the law when he triggered the National Guard in reaction to current anti-immigration enforcement demonstrations and riots in Los Angeles County, California.
Judge Charles Breyer, a Clinton appointee, consistently drew contrasts to a monarchy as he weighed Democratic Gov. Gavin Newsom’s demand that the court momentarily limit Trump’s power to utilize the National Guard.
Breyer stated the United States is not ruled by a king which governmental power has restrictions.

Breyer, who is the bro of retired liberal Supreme Court Justice Stephen Breyer, did not make any choices from the bench throughout the hearing and did not signify how he would rule. He showed that a choice would come as quickly as Thursday night.
The judge’s remarks came as he weighed arguments provided by DOJ Civil Department head Brett Shumate. Shumate argued the courts do not even have authority to examine Trump’s invocation of Title 10, a set of laws that sets out what systems a president can utilize to federalize National Guard members.
The National Guard is a state-based military force under the double control of presidents and guvs. Usually, a president triggers the National Guard with a guv’s authorization.
However, as shown in the courtroom in Northern California on Thursday, the law leaves space for argument about whether a guv’s approval is essential.
